Affirmative and defensive asylum applications for those fleeing persecution based on race, religion, nationality, political opinion, or membership in a particular social group.
Common questions
What is the one-year filing deadline?
You must generally file your asylum application within one year of arriving in the United States. There are limited exceptions for changed or extraordinary circumstances — but the bar is high. File as soon as possible.
What is the difference between affirmative and defensive asylum?
Affirmative asylum is filed proactively with USCIS when you are not in removal proceedings. Defensive asylum is raised as a defense before an immigration judge when you are in removal proceedings.
Can my family be included in my asylum case?
Yes. Your spouse and unmarried children under 21 who are in the U.S. can be included as derivatives on your asylum application. Family members abroad may follow-to-join once your case is approved.
